Welcome to TheCultureSource. By using theculturesource.com or the TheCultureSource iOS app (the "Service"), you agree to these Terms.
1. What the Service is
TheCultureSource is an events discovery and information service for the New York City area. We aggregate, curate and present event listings from ticket sellers, venues and public sources, and recommend events based on your stated tastes.
2. What the Service is not
We do not sell tickets, process payments or act as agent for any venue, promoter or ticket seller. All ticket purchases are made directly with third-party sellers under their own terms. We have no control over pricing, availability, refunds, cancellations or entry policies.
3. Accuracy of listings
Event details (dates, times, prices, lineups, venues) come from third-party sources and change frequently. We work to keep listings current but do not guarantee accuracy or completeness. Always confirm details with the seller or venue before purchasing or attending.
4. Third-party links and affiliate relationships
The Service contains links to third-party websites. Some are affiliate links through which we may earn a commission at no additional cost to you (see our Affiliate Disclosure). We are not responsible for the content, policies or practices of third-party sites.
5. Acceptable use
You agree not to: scrape, harvest or bulk-download content from the Service; interfere with or disrupt the Service; use the Service for any unlawful purpose; or misrepresent your affiliation with TheCultureSource.
6. Intellectual property
TheCultureSource name, logo, site design, editorial descriptions, curation and software are owned by No Permission Labs, LLC and protected by applicable law. Event names, artist names, venue names and images belong to their respective owners and are used for identification and informational purposes.
7. Newsletter and accounts
By subscribing to our newsletter you consent to receive periodic emails; you may unsubscribe at any time. If the app offers accounts, you are responsible for maintaining the security of your credentials.
8. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
9. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, THECULTURESOURCE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS ARISING FROM TICKET PURCHASES, EVENT CANCELLATIONS OR CHANGES, OR RELIANCE ON LISTING INFORMATION. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).
10. Governing law
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. Any dispute shall be brought in the state or federal courts located in New York County, New York.
11. Changes
We may update these Terms. Continued use of the Service after changes are posted constitutes acceptance.
